1. Acceptance of Terms

By downloading, installing, or using the CarFy mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

CarFy is a car maintenance tracking application that allows you to:

• Track vehicle maintenance history, costs, and mileage
• Set maintenance reminders
• Store photos of maintenance work and receipts
• Find nearby automotive services
• Track vehicle performance metrics
• Generate maintenance reports
• Create and manage local backups of your data

3. User Eligibility

3.1 Age Requirement

• CarFy is intended for users 16 years of age or older (typical driving age)
• Users under 18 may use the App with parental consent
• The App is NOT designed for children under 13

3.2 Legal Capacity

By using CarFy, you represent that:

• You have the legal capacity to enter into this agreement
• You are not prohibited from using the App under applicable laws

4. User Responsibilities

4.1 Accurate Information

You are responsible for:

• Entering accurate vehicle and maintenance information
• Keeping your data up to date
• Verifying all cost calculations and statistics

4.2 Data Backup

4.3 Legal Compliance

You agree to use the App in compliance with:

• All applicable local, state, national, and international laws
• Traffic and driving laws (do NOT use the app while driving)
• Privacy laws regarding photos and location data

4.4 Prohibited Uses

You agree NOT to:

• Use the App while operating a vehicle (except for hands-free features)
• Reverse engineer, decompile, or disassemble the App
• Use the App for illegal purposes
• Attempt to gain unauthorized access to our systems
• Share malicious content or spam through backup sharing
• Violate the privacy rights of others

5. Intellectual Property Rights

5.1 App Ownership

CarFy, including all content, features, and functionality, is owned by CarFy Team and is protected by:

• Copyright laws
• Trademark laws
• Other intellectual property rights

5.2 Limited License

We grant you a non-exclusive, non-transferable, revocable license to use CarFy for personal, non-commercial purposes.

You may NOT:

• Copy, modify, or distribute the App
• Create derivative works
• Use the App for commercial purposes without permission
• Remove or alter copyright notices

5.3 Your Content

You retain all rights to:

• Data you enter into the App
• Photos you upload
• Notes and records you create

By using the App, you grant CarFy a license to display your content locally on your device only for the purpose of providing App functionality.

• Google Gemini API (car facts)
• API Ninjas (VIN decoder)
• OpenStreetMap Overpass API (nearby places)
• Google Play Services (location)
• Google Analytics / AdMob (future implementation)

These services have their own terms and privacy policies. We are not responsible for their practices.

7. Disclaimers and Limitations

7.1 "AS IS" Basis

7.2 No Professional Advice

CarFy is for informational and tracking purposes only. It does NOT provide:

• Professional mechanical advice
• Vehicle safety assessments
• Legal or financial advice
• Certified maintenance schedules

Always consult qualified professionals for vehicle maintenance.

7.3 Accuracy of Information

We do NOT guarantee:

• Accuracy of cost calculations, fuel efficiency, or statistics
• Accuracy of VIN decoder results
• Completeness of nearby places data
• Reliability of third-party API data

7.4 Performance Tracking Disclaimer

7.5 Location-Based Services

Location accuracy depends on:

• GPS signal strength
• Device hardware
• Environmental conditions

We do NOT guarantee location accuracy and are not liable for:

• Incorrect location data
• Navigation errors
• Nearby places inaccuracies

8. Limitation of Liability

8.1 Direct Damages

• Data loss or corruption
• Device damage
• Financial losses from inaccurate data

8.2 Indirect Damages

• Lost profits or business opportunities
• Loss of use or data
• Cost of substitute services
• Consequential, incidental, or punitive damages

8.3 Third-Party Actions

• Actions of third-party APIs or services
• Malware or viruses from external sources
• Unauthorized access to your device

9. Indemnification

You agree to indemnify, defend, and hold harmless CarFy Team from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Your use of performance tracking features
• Content you share via backups or exports

10. Updates and Modifications

10.1 App Updates

We may release updates to:

• Fix bugs and improve performance
• Add new features
• Enhance security
• Comply with legal requirements

You are responsible for updating the App. Outdated versions may not function properly.

10.2 Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective:

• Immediately upon posting in the App
• For material changes: 30 days after notification

Continued use of the App after changes constitutes acceptance.

11. Termination

11.1 By You

You may stop using the App at any time by uninstalling it from your device.

Upon termination:

• Your license to use the App ends
• You must uninstall the App
• Locally stored data remains on your device until you delete it
• Sections 5, 7, 8, 9, and 12 survive termination

12. Dispute Resolution

12.1 Informal Resolution

Before filing a legal claim, please contact us at carfy.apps@gmail.com to resolve the issue informally.

12.2 Governing Law

These Terms are governed by the laws of your jurisdiction without regard to conflict of law principles.

12.3 Arbitration

Any disputes shall be resolved through binding arbitration rather than in court, except:

• Small claims court disputes
• Intellectual property disputes

12.4 Class Action Waiver

You agree to resolve disputes individually, NOT as part of a class action or collective lawsuit.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CarFy Team.

13.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

13.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

13.4 Assignment

You may NOT transfer your rights under these Terms. We may assign our rights to a third party.

These Terms are provided in English. Translations may be available but the English version governs.

13.7 No Partnership

These Terms do not create a partnership, joint venture, or agency relationship.

If you download CarFy from Google Play Store, you also agree to Google's Terms of Service:
